Misc. Docket No. 17-009 ORDER CONCERNING ADOPTION OF TEXAS RULE OF APPELLATE PROCEDURE 4.6 ORDERED that: 1) By order dated June 5, 2017, in Misc. Docket No. 17-007, the Court of Criminal Appeals promulgated Rule of Appellate Procedure 4.6, effective September 1, 2017. The public comment period has expired. 2) The Court of Criminal Appeals has determined that implementation of this rule should be delayed to allow the Court time to thoroughly consider public comments received during the comment period. Therefore, Rule of Appellate Procedure 4.6 will not become effective on September 1, 2017. 3) The Clerk is directed to: a. file a copy of this order with the Secretary of State; b. cause a copy of this order to be mailed to each registered member of the State Bar of Texas by publication in the Texas Bar Journal; c. send a copy of this order to each elected member of the Legislature; and d. submit a copy of the order for publication in the Texas Register.
